Term of Agreement: This Agreement governs temporary occupancy for either the 14 day stay or 28 day stay as indicated in Pinezanita RV Park & Campgrounds reservation system. It is non-renewable and does not create tenancy or residency rights. If you need clarification of your amount of stay please contact the office.
Rate and Payment: Payment must be paid in full upon signing this agreement. Utilities, including power and propane, are the responsibility of the guest. A late charge of $50.00 will apply to payments received more than 5 days after the due date. A charge of $75.00 will apply for any returned checks. Payment is to be by direct bank checking account. Otherwise, credit cards are accepted with a 3% no refundable fee. Debit cards can also be used with a 3% non refundable charge per transaction. $5 booking/technology will be applied to all billing.
Electric Billing Agreement: Guest agrees that all electric charges incurred during the stay term will be billed as trailing charges, meaning the charges will reflect actual usage for the preceding billing period. Guest further agrees to provide and maintain a valid credit card or bank checking account on file with Management. Electric bills will be processed automatically when due, using the payment method on file. Failure to maintain accurate payment information or sufficient funds may result in late fees as outlined in this agreement and/or interruption of utility services.
Compliance with Rules and Regulations: Guests agree to abide by all Park Rules and Regulations, which include: Management reserves the right to deny stay/occupancy privileges and remove any recreational vehicle or occupant who fails to comply with Park Rules and Regulations or disturbs others. No subletting or renting of recreational vehicles or sites is allowed. Quiet hours are from 9:00 PM to 8:00 AM. Vehicle radios are not permitted at any time.
Site Occupancy and Usage: Maximum occupancy per site is four persons and those listed under Guest Information section. Guests and their vehicles must be registered with the Park office. Additional charges apply for unregistered guests or vehicles. No site excavation, pruning, or construction is allowed without prior written approval from management.
Placard Requirement: 14 Day Guest(s) are required to take a placard upon check-in at the beginning of their 14-day stay. This placard must be displayed in a visible location and must be returned to the Park office at the end of their stay. Failure to return the placard may result in additional charges.
Maintenance and Cleanliness: All RVs must be 10 years old or newer or have written permission from management to remain in the Park. Sites must be kept clean and free of debris. RVs must be properly maintained and kept in a sightly manner. Guests are responsible for repairing water leaks and maintaining sewer connections as per Title 25 of the California Recreational Vehicle Code. Spaces with propane tanks, guests are responsible for any repairs if guests wants to continue service with All State Propane.
Vehicles and Parking:. A maximum of two vehicles per site is allowed. Vehicles must be parked entirely within the assigned site. Inoperable vehicles are not allowed on-site, and all vehicles must have current registration.
Pets: No vicious animals are allowed on the premises at any time, no matter the breed. Due to insurance purposes, the following breeds are not permitted: Pit Bull, Staffordshire Terriers, Rottweilers, German Shepherds, Chow Chows, Doberman Pinschers, Akitas, Wolf-hybrids, Mastiffs, Great Danes, Alaskan Malamutes, Siberian Huskies, etc.
Exception for registered service animals only: Therapy dogs (emotional support) are not covered under ADA protections. Guest(s) are responsible for their pets at all times. Pets are not permitted to be unattended in the park or create any nuisance. If your pet defecates on the premises, it is your responsibility as its owner to pick it up and dispose of it properly.
Visitors: Overnight visitors are subject to a fee of $5.00 per person per night. Guests/Visitors may not set up tents or camp on the assigned site. Additional sites must be rented for such purposes.
Trash and Waste: Only household trash may be disposed of in the Park dumpsters. Large items, construction debris, and non-household waste must be disposed of off-site.
Termination and Removal: Your recreational vehicle may be removed from the premises for reasons specified in Civil Code Sections 799.22 and 1866, including but not limited to nonpayment of stay agreement , utilities, camping fees, or reasonable incidental service charges; failure to comply with local, state, or federal laws or Park Rules and Regulations; conduct constituting a substantial annoyance to other occupants, tenants, or residents; and conviction of the Guest for acts committed on the Park premises.
Right of Entry: The Park retains the right to enter the Guest’s space during normal hours for maintenance, emergencies, or inspection to ensure compliance with this agreement and Park rules.
Guest(s) Right to Access:  Guest(s) are granted access to their recreational vehicles and the Park at any time under normal circumstances. In the event of a natural disaster (fire, earthquake, etc.) Guest(s) agrees that if an evacuation order is in place for the Julian community, that they will observe the evacuation order and that they will not be granted access to their recreational vehicle or the Park until such time as the evacuation order is lifted.
Guest Responsibilities: Guests are responsible for keeping the space clean and free of debris, ensuring all vehicles and RVs on-site are properly maintained and registered, supervising their guests, and ensuring their adherence to Park rules. Guests must remove their RV and all belongings from the site by the expiration of this agreement. Guests must vacate for a minimum of 24–48 hours before entering into another stay agreement to comply with legal requirements. Guests must also observe evacuation orders in the event of natural disasters such as fires or earthquakes.
Power Outages: Please be advised that Pinezanita RV Park & Campgrounds is not responsible for power outages caused by SDG&E (San Diego Gas & Electric). During high wind advisories or other circumstances where SDG&E deems it necessary to shut off power for safety reasons, guests may experience temporary power interruptions. We recommend that guests come prepared with alternative power sources, such as a generator, to ensure their comfort during these outages. Changes in Rules, Standards of Maintenance, Regulations, Services, Equipment or Physical Improvement: The Park’s Rules and Regulations, standards of maintenance of physical improvements in the Park, together with services (including utilities), equipment and physical improvements within the Park may be changed from time to time as provided by any law then in effect
Limitation of Liability: The Park is not responsible for any loss or damage to the Guest’s property or injuries sustained while on the premises, except as required by law. The Guest assumes all risk for loss or damage unless caused by the gross negligence of the Park.
Attorney’s Fees and Costs: In any action arising out of guest(s) stay/occupancy from this Agreement the prevailing party shall be entitled to reasonable attorney’s fees and costs. A party shall be deemed a prevailing party if the judgement is rendered in his or her favor or where the litigation is dismissed in his or her favor prior to or during the trial, unless the parties otherwise agree in the settlement or compromise.
Interpretation:  Each provision of this Agreement is separate, distinct, and individually enforceable. In the event any provision is declared to be unlawful or unenforceable, the validity of all other provisions shall not be affected.
Legal Compliance: This agreement is governed by the laws of the State of California, including the Recreational Vehicle Park Occupancy Law. The Guest acknowledges receipt of and agrees to comply with these laws.
Acknowledgment and Agreement: By signing below, the Guest acknowledges they have read, understood, and agreed to all terms and conditions set forth in this agreement and the Park Rules and Regulations.

PARK RULES AND REGULATIONS
 
Management reserves the right to deny stay/occupancy privileges and to remove any recreational vehicle or guest(s) who fails to comply with the Rules and Regulations set forth, disturbs others or refuses to comply with the directives of our staff and/or management.
 
SITE STAY/OCCUPANCY TERMINATION.  Stay/Occupancy approval will immediately be withdrawn whenever the guest (or their guests):
Fails to obey Park Rules and Regulations as set forth in this document.
Performs any act or action which violates any local, state, or federal ordinance, law, or regulation while on Apple Ridge RV & Camp LLC property.
Fails to pay stay agreement fee and all additional charges on or before its due date.
Write checks with insufficient funds for any reason.
Fails to maintain the RV and site in a clean, neat and attractive manner.
Conducts themselves in a manner that constitutes an annoyance to others.
 
PROPERTY RIGHTS.  The property that your recreational vehicle occupies belongs to and is owned by Apple Ridge RV & Camp LLC., a.k.a. Pinezanita RV Park & Campgrounds; referred to in the balance of this document as “Park”.
COMPLIANCE WITH LAWS: Guest(s) shall comply with all local, state, or federal laws during their stay with the park. Guest(s) shall be responsible for their guest’s compliance with all local, state, or federal laws as well as the Rules and Regulations of the Park set forth herewith and acknowledge that a violation of this provision will be grounds for eviction from the park.
SPACE OCCUPANCY/USE OF SPACE: No person other than those listed in the Stay Agreement may occupy the premises.  Guest(s) is personally responsible for all the actions and conduct of their guests on the park premises and common areas. There are charges for overnight guests (see Para. 14). 
ENTRY UPON GUEST(S) SPACE: The Park shall have a right of entry upon the land on which a recreational vehicle is situated during normal working hours for maintenance of utilities, maintenance of premises (if the guest fails to do so), and the protection of the park.  However, such an entry shall not be in a manner or at a time which would interfere with the Guest(s) enjoyment.  The Park may enter a recreational vehicle without the prior written consent of the Guest(s) in the case of emergency or when the Guest(s) has abandoned the recreational vehicle.
 
RESIDENCY.  This is NOT a residency park. You may NOT sublet your Recreational Vehicle, Trailer, or site to anyone at any time. Effective May 1, 2018, permanent residency can be granted under special circumstances at Pinezanita.  Permanent residency is extremely limited due to our septic systems and bears special approval from an Officer of Apple Ridge RV & Camp LLC.
LENGTH OF STAY.  Sites are on a 28-calendar day basis. Each site is subject to its own fee and its own length of stay and cannot be transferred or carried over to another site. Agreement is for a maximum of 14  or 28 calendar days only per month based on your initial application and as indicated in Pinezanita RV Park & Campgrounds booking system. GUEST(S) RIGHT TO ACCESS: Guest(s) are granted access to their recreational vehicles and the Park at any time under normal circumstances. In the event of a natural disaster (fire, earthquake, etc.)  Guest(s) agree that if an evacuation order is in place for the Julian community, that they will observe the evacuation order and that they will not be granted access to their recreational vehicle or the Park until such time as the evacuation order is lifted.
RENTING, SUBLEASING, OR SUBLETTING: Guest(s) shall not rent, sublease, sublet any portion of the Guest(s) recreational vehicle or the premises. Guest(s) shall not assign their interest in their Stay Guest Agreement, no consent to any assignment, encumbrance, sublease or other renting shall constitute a waiver of the provisions of this paragraph.  Apple Ridge RV & Camp LLC makes this agreement only to the Guest(s) listed and signing a Stay Agreement.
MAINTENANCE/CONSTRUCTION:
GENERAL: Fences and Decks, storage sheds, platforms, or building(s) any other structures are not permitted. Pre-existing Fences and Decks, storage sheds, platforms, or building(s) or other structures are grandfathered in. There will be no replacement if the structure is deemed in poor condition.
When Guest(s) removes their RV from their site, all fences, decks, etc. will be removed by the RV owner/Guest at their expense. Park dumpsters may NOT be used for demolition disposal at any time.  Under certain circumstances, the Park may agree to haul your debris to a transfer station. Guest(s) would be required to pay the costs incurred for demolition and disposal fees.  Any construction done at your site must be done to allow for easy removal of your RV in case of an emergency.  No concrete is to be used at any time for the installation of any item.  No digging is permitted without prior approval of the park. Pre-existing Fences, decks, sheds, etc. must be maintained with a good coat of paint or sealer and always kept in a sightly manner.
SPACE: Guests are solely responsible for the initial installation of their RV within the space to the agreement of the park. If the RV is placed in a manner not agreeable to the park, the Guest(s) must re-position the RV in an agreeable location within the space at their expense. All RVs must be backed in or driven into the site in a manner that ensures all utility hookups and lines are properly connected without running underneath the trailer. Any work done on the premises of the occupied space by Guest(s) must bear the written approval of the Park prior to commencement of the work to be done.  If the Guest(s) does not have the written approval of the park, the Guest(s) will run the risk of removing any non-permitted construction or improvement at the expense of the Guest(s).  All work performed on Guest(s) space must be completed in workmanlike fashion and in compliance with all required permits, health, and safety standards.  Guest(s) hereby agrees to indemnify and hold the Park harmless for any damages due to work which is improperly done.
 
RV’s, Mobile homes and Room Additions:  Your RV/Mobile home outside appearance must be kept clean on a regular basis.  Your RV should be washed at least once per year at a minimum.
Mobile homes, RV’s, and room additions that have been painted must be maintained on a regular basis and/or completely re-painted when needed.
 
VEHICLES.  There are a maximum of 2 vehicles parked on your site when you are here, if space allows.  An inoperable vehicle cannot be stored on the space.  Vehicles must be parked completely on YOUR assigned site. No vehicle part or appendage may protrude that is resting over or resting upon a paved street or thoroughfare. Motor homes, cars, pickups, and boats must be registered with the office and have current up to date tags as per Title 25, San Diego County, and California DMV.  There will be an extra charge for all extra vehicles left on Park property. Current storage pricing and availability can be obtained by contacting the Park office. 
PETS.  Dogs & other pets are the responsibility of the owner.  Only indoor cats are allowed. If there is a complaint about your pet(s) (noise, cleanliness, or annoyances), the Park reserves the right to require their removal.  For our guests’ safety, please keep your pet(s) on a leash or inside of your vehicle. California Health and Safety Code, Section 18601, and California Code of Regulations, Chapter 2, Section 1608, prohibit any domestic animal from being loose in the park.  This includes cats. It is mandatory for all pet owners to clean up their pets’ waste immediately. Owners are not to allow their pets to urinate or defecate on “Green Areas” (lawns)   All pets must be in the presence of their owner at all times when outside.
VISITOR(S).  It is the Guest(s)’s responsibility to acquaint all Visitors with the conditions of park rules and regulations. Guest(s) is personally responsible for all the actions and conduct of their visitor(s) on any part of, or area of the Park. Your rates DO NOT include visits of visitors.
CURRENT RATES FOR OVERNIGHT VISITORS ARE $5.00 PER PERSON, PER DAY, AND YOU ARE REQUIRED TO REGISTER YOUR
VISITORS WITH THE OFFICE. VISITORS ARE NOT ALLOWED TO SET-UP CAMP OR
TENTS ON YOUR SITE UNDER ANY CIRCUMSTANCES. 
Visitors wishing to camp must obtain a camping permit from the office and be ASSIGNED TO their own site for camping. 
THERE IS A SIX PERSON PER SITE MAXIMUM IN EFFECT AT ALL TIMES.  PARK APPROVAL IS REQUIRED FOR GATHERINGS RESULTING IN MORE THAN SIX PERSONS PER SITE (GUEST(S) + VISITORS.
 
SOLICITATION. Solicitation of any kind is not permitted within the confines of the Park. This includes solicitation for money or funds for investment.
Before any Recreational Vehicle/Mobilehome is to be sold, you must first have the approval of Apple Ridge RV & Camp LLC to sell the vehicle/mobilehome in place on a site
.
 
FISHING POND.  No swimming, boating, rafting, inner tubing or throwing of any objects will be permitted at any time.  The pond is for fishing ONLY and is catch and release. No children under the age of 12 are allowed at the lake without adult supervision. Fishing for Park Guest(s) is currently free.
SPEED LIMITS, CAMPFIRES AND FIREARMS. Absolutely no motor driven cycles are permitted to be operated inside the park other than to enter or leave the park by main road.  The speed limit is 10 MPH. Keep fires low and small.  NO BONFIRES!  No collecting of wood in bushes or breaking branches.  This includes bordering properties (Penal Code no. 6021).  Wood is for sale at the office.
CAMPFIRES MUST BE KEPT SMALL AND COMPLETELY EXTINGUISHED WITH WATER BY 11:00 p.m.   If a No Burn Proclamation or Red Flag Warning is in effect, all campfires will be banned until such time as the No Burn Proclamation or Red Flag Warning has been lifted and resumption approval has been obtained from local fire authorities.  Guest(s)s will be notified verbally or by posted notice in the office as to the status of any No Burn Proclamation or Red Flag Warning.  Absolutely no firearms or weapons of any kind are allowed on the property, this includes BB guns, bow and arrows, crossbows etc.
SITE CLEANLINESS AND OUTSIDE STORAGE.  No items may be stored under your Recreational Vehicle at any time as per Title 25 of the California Recreational Vehicle Code.  Your site must be always kept in a slightly manner.  Site excavation and pruning of trees, bushes, and shrubbery are to be approved by Park management.  Your RV and any/all Pre-existing fences, decks, sheds, room additions, skirting etc. must be maintained with a good coat of paint or sealer and always kept in a sightly manner. We reserve the right to remove any excess items from your lot or from under your trailer upon notification and non-compliance.   Should we have to clean up your site or perform any maintenance on your RV, Mobile home, room addition, sheds, fences, etc. due to non-compliance, we reserve the right to add a $25.00 per manhour charge to your bill. In addition, you may be billed for any charges incurred for painting and/or materials for the clean-up/maintenance plus any necessary disposal fees. To maintain the aesthetics and functionality of the park, personal belongings and decorative items are limited to 2-3 small items per site. All outdoor furniture must be easily removable to ensure safety and compliance with park guidelines. Items such as trinkets, permanent fixtures, or excessive decorations are not permitted.
NOISE.  You, your children, your visitors, and your pets must conduct themselves in a manner that does not create disturbance or annoyance to others. Violation of this rule can result in the termination of your site stay agreement with the park.  Children, pets, and visitors are not allowed to cross through any other Site in the park at any time.  Be considerate of others by always keeping TV and radio volumes low and observing quiet hours from 9:00 p.m. to 8:00 a.m.  Vehicle radios are not permitted at any time.
TRASH. Only normal household trash may be placed within our dumpsters.  Normal household trash DOES NOT INCLUDE old furniture (indoor or outdoor), lumber, demolition of any kind, old BBQ’s, electronics, car parts, old carpets, limbs, leaves, tires, pallets, or any large item of any kind.  Any item covered above is not normal household trash must be transported by you to the nearest refuse disposal area for disposal.  There are no exceptions.
 
NEIGHBORS. We ask that you be a good neighbor and do unto others as you would have them do unto you.  Be considerate and realize that everyone comes here to rest and relax and that everyone has every right to expect nothing less.
PARK PERSONNEL: Guest(s) shall not request assistance from Park employees for personal reasons during their working hours, except in emergency situations. Any Guest(s) hiring any Park employee after normal working hours hereby acknowledges that employee is not covered by the Parks’ insurance for private jobs performed for Guest(s) during employee’s off-hours time. Guest(s) or Guest(s) visitor(s) shall not harass, harm, or threaten any Park employee or their family.
 
DAMAGE TO GUEST(S)S PROPERTY, INDIVIDUAL SPACES, COMMON AREAS:
 
Loss:  The Park is not responsible for any loss due to fire, natural causes, acts of God, accident, theft, malicious mischief, or any other loss whatsoever which arises by reason of any other cause than the specific negligence or intentional act of Management or its’ employees.  Guest(s) and their visitor(s) hereby assume all risk of loss due to any cause whatsoever other than the exceptions set forth above.
Liability for Damages: Guest(s) will be solely responsible for any injury to themselves or their visitors while upon the premises or common area of the Park and agrees to reimburse the Park for damages done to any park facility, building, street, utility, or property caused directly or indirectly by Guest(s) or their visitor(s).
 
MISCELLANEOUS:
 
PROPANE: Propane is available at the office during normal office hours.  Please don’t wait until you are out of gas or after hours to call us for propane.  All Propane tanks must be securely fastened to your RV.
SEWER: Sewer connections must be tight and clamped at both ends at all times.  Sewer connections must be inspected regularly for deterioration and holes.  Any worn hoses, pipes, or connections must be replaced or repaired immediately.
WATER LEAKS: All water leaks must be repaired immediately.  Please notify the office if you observe any water leaks.

RECREATIONAL VEHICLE OWNERS:
 
THESE ARE THE RULES OF PINEZANITA RV PARK & CAMPGROUNDS (“PARK”).  THEY HAVE BEEN PREPARED IN ACCORDANCE WITH THE PROVISIONS OF THE RECREATIONAL VEHICLE PARK OCCUPANCY LAW.  VIOLATION OF THESE RULES WILL GIVE PINEZANITA RV PARK & CAMPGROUNDS CAUSE TO REMOVE ANYONE OCCUPYING IN THE SPACE PURSUANT TO SEC 799.20 ET SEQ., OF THE CALIFORNIA CIVIL CODE, AND/OR CAUSE TO OBTAIN AN INJUNCTION AGAINST THE GUEST(S), ENJOINING THE HOMEOWNER(S) OR THEIR GUEST FROM FURTHER RULE VIOLATION, PURSUANT TO SECTION 526 ET SEQ. OF THE CALIFORNIA CODE OF CIVIL PROCEDURE.  IF ANY OF THESE RULES ARE UNCLEAR, PARK MANAGEMENT SHOULD BE CONTACTED FOR AN EXPLANATION.  THESE RULES MAY BE CHANGED FROM TIME TO TIME. BY EXECUTING THE STAY AGREEMENT TO WHICH THESE RULES PERTAIN, RECREATIONAL VEHICLE OWNER(S) ACKNOWLEDGE THAT THEY ARE IN EVERY RESPECT REASONABLE AND “CONSENT” TO THEM.
 
RV OWNER(S), BY SIGNATURE BELOW, ACKNOWLEDGES THAT THEY HAVE READ THE  RULES  AND REGULATIONS AND AGREES TO ABIDE BY THE SAME DURING THEIR OCCUPANCY IN THE PARK.  THESE RULES AND REGULATIONS MAY BE CHANGED ACCORDING TO THE PROVISIONS OF THE RV OCCUPANCY LAW.  RV OWNERS FURTHER ACKNOWLEDGE HAVING RECEIVED A COPY THEREOF.
